Probably one of the top 2 highlights of my trip was going ZIPLINING!!!! Yes, no joke. Mom was planning on going too until Griffin reminded her that she is scared of heights! haha. So she went to the botanical gardens while I joined other USBank winners from around the US to go Ziplining!
The ziplining course was actually on a ranch.


This is a picture of one of my instructors and one of my group members. Our instructors were awesome! They taught us where to hold the cords in a way we could control what direction we faced or if we wanted to spin in circles as we zoomed across etc. I learned how to give myself as much speed as possible by holding my legs up close to me and toward the sky as well.Isn't it gorgous? We got to zip over rivers, streams, rainforest terrain and more! Gosh it was so paradisiacal!
Also as part of the adventure we got to walk across this bridge with huge gaps in the steps. Seriously we were about 150 feet above a river which looked super tiny while looking down. The big branches and rocks stood out to me beneath as I imagined what it would be like to fall onto them... and yes that is me on the bridge :)

I had a couple short videos but I couldn't figure out how to post them. One of the best parts was when we, as a group, hiked to a nearby pond with a waterfall. This is me about to jump in! You can see many of my group members already had and were tubing in the background. It was so gorgous and relaxing that I really could have stayed in there for over an hour.

...but I couldn't because we still had more ziplining to do! This is the very last one...the King Kong. I'm trying to remember just how long it really was ...I think it was 1200 feet long. Those of us who don't weigh very much had to really get a running jump into it because we don't have much weight to carry us all the way across. But with good form (putting my legs up...booty first) I made it!
I couldn't not include this... This is a baby pineapple. Apparently it takes over one year for just one pineapple to mature! I never knew that!

They very nearly did get
me once; it was the second to last week before we went on stand-down for the
final exams before I could leave school for good. I was in History class which
we had in the library, a room often used by kids avoiding PE and Games, in fact
I had spent many an hour in an out of the way corner keeping my headdown and been
unnoticed by all. On this near catastrophic day a PE teacher who had started at
the school when I was in the second year came in and told our teacher that he
was looking for dodgers. The librarian said “Everyone in here should be,
they`re all mine.” But the PE teacher was looking around and saw me who he did
not recognize and said “Who are you?” I gulped and the librarian said “He`s
with me” but the PE teacher carried on “I don`t know you!!” that was echoed
around the class. Bright red and shouting, he went on “When do you do games?”
Of cause I had not been to that part of the school for four and a half years,
but I said “Monday afternoon sir” by now the veins on his forehead were
standing out and everyone was expecting him to explode, literally He screamed
“I want to see you there!!” As he left the room the class were still coming to
terms with the fact that I had not been to the gym for all that time.
Come Monday I thought it
better to take the whole day off and did just that, Well… I`d nothing to wear!

Over the next few weeks I
took my exams, went back to school for one last day. That was the happiest day
of my life at the time, and I walked away with my head held high (and my arse
intact) and NEVER LOOKED BACK. I didn`t even go back for my results!

Should Worker's Compensation be a shared responsibility


We all know the reason for workers' compensation. We give up the right to sue a company for injuries that happen at the workplace (although it is possible to sue another company that made the equipment responsible for the injury, in a product liability lawsuit). In exchange the province's compensation board will pay replacement income. It may be partial if we have to resort to modified work. For example, if taking modified work reduces a salary by 15%, comp will pay an amount equal to 15% of after-tax income, since benefits are tax-free. In some cases, it could be as much as 60% or more of after-tax if we are totally unable to resume work (the rest would be covered by a CPP or RRQ disability pension which is taxable).

In some provinces, a province's worker's comp board is just that, it is solely focused on determining compensation.

Some other provinces, however, have a dual mandate for the service -- not just paying compensation for injuries but also trying to prevent injuries, in other words promoting workplace occupational health and safety. These provinces include BC, Ontario and Québec (with their CSST). That makes sense, we should have as an aim keeping injuries at work to a minimum -- after all, healthy employees reduces overhead related to the costs of workplace related absenteeism.

In all cases, though, the responsibility for paying premiums for worker's compensation is solely the responsibility of employers. Employees pay nothing. In fact, it is this payroll tax (anywhere from 1.12% to 2.75% depending on the jurisdiction) that many companies claim is a disincentive to expand their operations.

What I'm writing next is probably a very unpopular position. But it is what I think.

In Canada, the CPP / RRQ and EI programs are shared between employers and employees (1:1 for pensions, 1.4:1 for unemployment).

This is an issue that has made me curious for quite some time. But after thinking about it, I think that worker's comp should also be a 1:1 proposition. Here's why.

A company has as a primary duty the safety of its employees. Whether it's in a factory or an office environment, people have the right to expect minimal to no disruption in their working lives. This means safe factory equipment with guards to prevent injury, readily accessible eyewash stations, computer stations that minimize Carpal-tunnel syndrome incidents, and of course and sadly the stress that can result from sexual and other types of harassment. And so forth.

But I think employees also have a reciprocating duty to contribute to workplace safety -- by avoiding risky behaviour. The benefits that come with worker's comp aren't free, someone has paid for them. I'm not just talking about slips and falls at the factory. They also happen at the office, for example if you rush to make a turn around a supervisor's "platform" and you slam your knee into a sharp corner during that turn. It also deals with harassment issues -- one just might think twice knowing their hard-earned money might be used to compensate for other people's physical and mental health costs. (Of course, this should not mean the rogue is exempt from being personally sued.)

Certainly, no one should be penalized financially for unintentional accidents, or even incidents where their was just plain idiocy on one's own person. In fact, firing an employee under such a circumstance should be illegal unless he or she deliberately endangered other persons. And there should always be zero tolerance for racial or sexual harassment because of the mental health implications.

Given all of that, I've in my working life seen risky behaviour both at the factory and at the office. And it bothers me that on this one item, employees think they can get a free ride. As I said, nothing is truly free. Giving workers peace of mind that they will be taken care of is part of our social safety net and it is a principle that should be protected. But it should also mean that employees should take responsibility not just for their own safety as much as is possible, but for taking care of their fellow workers too and protecting their safety as much as employers should. That's why an employee payroll tax for worker's compensation is warranted.

If employees had premiums deducted from their pay cheques (which would be fully tax-deductible, of course, just like the other payroll taxes) it might make them think twice before doing something inherently risky or just plain stupid. And giving employers a bit of a break would be an incentive to hire new staffers.

This change doesn't have to be done overnight. It can be phased in over four years to give us time to adjust. But for the most part, the system we have is stuck in a World War I mentality (the period when most provinces set up their régimes). It needs to change. And making it a shared responsibility is one way to do so.

Chris and I loaded up to head down to play some Bolt Action at the Darkside in Sarasota. Alas, Lee could not play but did make it down to buy a few goodies at the store, hang out and did eat some breakfast with us before we played. Good Amish food is always a good start!

I brought a mixed bag list that had mixed results....fancy that!

My first round opponent, forgot the gents name but is a local to Darkside and a Japanese player.We got the mission Top Secret and we got to play on the nice bombed out hamlet that turned out rather nicely. The Japanese list had no vehicles except for a truck and a few squads all veteran which made for a tough as nails but small list.The game opened up with a cat and mouse game but then the game slanted quickly in my favor as I was able to take out the Japanese with some focused fire. The game did get tough when the truck took a hit and blew up with the squad with the objective. I had to wait for another two turns to win near the end with the the forward observers grabbing the objective and running it to the snipers to get it off the table. The Volks Grenaider didn't impress me much as I rolled a 1 for one squad and they took a ton of pins and was useless for most of the rest of the game.

The table....both armies are in a standoff. I did manage to crush a few of his units but Tom buttons down like fleas on a dog and waits for me.

They burned down a squad before they met their end.In the end neither of us could touch the other players objective and it was a clear draw.I go into the third round with 4 people in the lead for possible 1st. I get John and his Alessio style American list....

(all in good fun of course) Let's not bring up those two other airstrikes that both was 1's and I bombed the hell out of two of his infantry units and also nailed his howitzer with my airstrike. Wow, two observers is VERY brutal. Yea, Alessio packed on the cheese for this list! Double everything!In the end I lost to John, dice was kinder to him in the end. It would have been a draw if a strange rule was allowed and a howitzer apparently can fire indirect OUTSIDE OF ITS FORWARD ARC! REALLY? I was not aware in WW2 we had guided shells in the war!In the end it was three good games with a 1-1-1 record with an untested list for the most part. Never played it before. Chris and I tied for 3rd place and we split the prize. Pretty cool in the end...Kudos to Tom and John making it down. Mike did a great job at Darkside.December may be an off month to relax and enjoy the holidays with January opening up a new year of Bolt Action gaming! We hope to plan a Wounded Warrior tournament in March perhaps as a nice fundraiser.

Practice point: The Appellate Division determined that the Supreme Court properly granted those branches of the defendant's
motion which were to compel him to sign authorizations for the release
of certain medical records, to compel him to appear for a deposition,
and to vacate the note of issue. The Supreme Court correctly compelled
the plaintiff to sign the authorizations since he placed his medical
condition at issue. The Supreme Court also correctly compelled the plaintiff to appear for a
deposition, as the defendant demonstrated that the deposition was
reasonably calculated to result in the disclosure of facts necessary to
defend the action. Since the defendant moved to vacate the note of issue within the time
prescribed for doing so pursuant to 22 NYCRR 202.21(e), and demonstrated
that discovery was not complete in that the deposition of the plaintiff
had not occurred, medical authorizations still had not been provided,
and the action was not ready for trial, the note of issue was properly
vacated.

Student note: The Appellate Division also found that the Supreme Court properly enjoined the plaintiff from submitting any further motions or cross motions without leave of the court, based on his abuse of the judicial process.

Case: Breytman v Olinville Realty, LLC, NY Slip Op 06538 (2d Dept. 2013).
